THE CURRENT CITY OF DECATUR ZONING ORDINANCE WAS ADOPTED MAY OF 2002.

OVER TIME, STAFF HAS DETERMINED CERTAIN AMENDMENTS ARE NECESSARY TO MAKE ZONING ORDINANCE MORE COMPREHENSIVE AND APPLICABLE TO THE CHANGING BUILT URBAN ENVIRONMENT WHILE KEEPING THE CHANGE, I'M SORRY.

THE CHARGE OF MAKING DECATUR A QUALITY PLACE TO LIVE, WORK, AND PLAY.

THE PROPOSED AMENDMENT TO THE ZONING ORDINANCE REDUCED THE QUORUM FOR THE Z B A MEETINGS FROM FIVE MEMBERS TO FOREIGN MEMBERS AND ALLOW THE HEARING OFFICERS TO PERFORM THE POWERS AND DUTIES OF THE ZONING BOARD OF APPEALS IF NEEDED.

THE CITY HAS RECENTLY HAD DIFFICULTIES MAKING THE QUORUM REQUIREMENT TO HOLD Z B A MEETING TO PERFORM THEIR POWER AND DUTIES, INCLUDING HOLDING NEEDED PUBLIC HEARINGS.

THE Z B A DOES NOT MEET ON A REGULAR BASIS BECAUSE OF A LACK OF PETITION, WHICH MAKES IT DIFFICULT TO MAINTAIN A FULL BOARD MEMBER OF SEVEN MEMBERS.

THE BOARD OF APPEALS HAD NO PETITION IN THE MEETING OF 2022 AND FIVE MEETINGS IN 2021.

THE PROPOSED CHANGES WILL PROVIDE THE CITY OPTION TO MEET THE CBAS REQUIREMENT IN A TIMELY MANNER.

STATE STATUTE ALLOWS FOR A MINIMUM OF QUORUM OF FOREIGN MEMBERS ON A BOARD OF APPEALS AND ALLOWS FOR A HEARING OFFICER TO PERFORM THE POWER AND DUTY OF A Z B A.

THE PROPOSED LANGUAGE FOR THE HEARING OFFICER IS IN COMPLIANT WITH THE STATE STATUTE.

CITY STAFF RECOMMEND APPROVAL OF THE PROPOSED AMENDMENTS.

WE KIND OF, I'LL, I'LL BE PUTTING IT ON, UH, GOING OVER THE STATUTORY REQUIREMENTS OF BEING PLAN COMMISSION, ZONING, BOARD MEMBER, UM, HOW THE STAFF PUTS THEIR REPORTS TOGETHER, WHICH IS, UH, CALLED THE FINDINGS OF FACT, UH, WHICH COMES FROM, UH, CASE LAW THAT STIPULATES HOW YOU SHOULD BE DECIDING ON

REZONING MATTER MATTERS OR VARIANCE MATTERS FOR THE ZONING BOARD.

SO WE'LL BE GOING OVER ALL OF THAT.
